These Terms of Service govern access to skydogjewelry.com and purchases from Skydog Jewelry LLC. By using the website or placing an order, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the website or place an order.

About SKYDOG

The website and related services are operated by Skydog Jewelry LLC, referred to in these Terms as SKYDOG, we, us, or our. Our mailing address is 668 North Coast Highway, PMB 290, Laguna Beach, California 92651. This is a mailing address only. Contact jordan@skydogjewelry.com before sending jewelry or other property.

Eligibility and permitted use

You must be legally able to enter a binding contract to place an order. You may use the website only for lawful personal purposes. You may not interfere with the website, attempt unauthorized access, introduce malicious code, scrape content in violation of law, misuse another person's information, or use the website to infringe the rights of SKYDOG or another person.

Products and handmade variation

SKYDOG jewelry is handmade or made to order unless a product page states otherwise. Gemstones, pearls, inlay materials, and other natural materials vary in color, pattern, clarity, inclusions, texture, and dimensions. Screen settings and photography may also affect appearance. These natural and handmade variations are not defects when the item materially matches its description.

We try to describe products accurately. Approximate measurements, carat weights, dimensions, colors, and production times are estimates unless expressly identified as exact. Product availability, stone availability, and pricing may change before an order is accepted.

Orders and acceptance

An order is an offer to purchase. We may accept, reject, limit, or cancel an order for lawful reasons, including incorrect pricing, unavailable materials, suspected fraud, shipping restrictions, or an error in product information. If we cancel an order we accepted, we will refund the amount paid for the canceled portion.

Customers are responsible for reviewing product details, metal, stone, size, spelling, engraving, shipping information, and other selections before submitting an order. We may contact you if additional information or design approval is required.

Prices and payment

Prices are shown in the currency displayed at checkout and exclude taxes, duties, brokerage charges, and other governmental charges unless stated otherwise. You authorize us and our payment providers to charge the payment method supplied for the order and applicable charges. You represent that you are authorized to use the payment method.

Made to order work and cancellations

SKYDOG begins design, sourcing, scheduling, and production work promptly after an order is placed. Orders may not be canceled after submission, including before physical fabrication begins. All made to order, custom, personalized, engraved, resized, ready to ship, sale, and one of a kind jewelry is final sale, subject to rights that cannot be waived under applicable law.Skydog Website Policy Package 3

Sizing and customer specifications

Customers are responsible for selecting the correct size. An incorrect customer selection is not a manufacturing defect. Many rings can be resized for a fee, but resizing depends on the design, construction, materials, gemstones, and requested adjustment. Inlay rings, eternity bands, and other continuous designs may not be resizable.

If a ring cannot be resized, contact us. At our discretion and on a case by case basis, we may offer a paid remake or replacement in another size. Any offer, price, credit, or accommodation is specific to that transaction and does not create an obligation in other cases.

Custom projects and approvals

Custom projects may require separate estimates, deposits, design approvals, and written project terms. Customer approval of a drawing, rendering, stone, material, size, inscription, or design authorizes SKYDOG to proceed. Changes requested after approval may be unavailable or may require additional time and payment. If separate written custom terms conflict with these Terms, the separate custom terms control for that project.

Customer supplied property

We may agree to work with customer supplied gemstones, heirlooms, or other property only after evaluation and written acceptance. Existing materials may contain hidden damage, treatments, instability, or weaknesses. A separate written agreement may allocate these risks. Do not send property without written authorization and shipping instructions.

Shipping and delivery

The Shipping and Delivery Policy is incorporated into these Terms. Production and shipping estimates are not guaranteed delivery dates unless we expressly agree otherwise in writing. Risk of loss and title transfer as provided by applicable law and the selected carrier terms. Customers must provide a secure, accurate delivery address and promptly report delivery problems.

Returns refunds warranty and repairs

The Returns Refunds and Cancellations Policy and the Six Month Limited Warranty and Repairs Policy are incorporated into these Terms. Final sale treatment does not eliminate remedies that cannot legally be excluded. SKYDOG determines warranty coverage after inspection. Unauthorized repair, resizing, or alteration may affect warranty eligibility.

Intellectual property

The website and its text, photographs, designs, drawings, renderings, graphics, logos, product names, trade dress, and other content are owned by or licensed to SKYDOG and are protected by applicable intellectual property laws. Except as allowed by law, you may not copy, reproduce, distribute, sell, create derivative works from, or commercially exploit our content without written permission.

Purchasing jewelry does not transfer intellectual property rights in the underlying design. Unless otherwise agreed in writing, SKYDOG may use and adapt its general techniques, design concepts, and nonconfidential know how. We will not intentionally publish a customer's private personal information without appropriate permission.

Customer submissions

You represent that you have the right to provide any photograph, artwork, inscription, trademark, design reference, testimonial, or other material you submit. You may not ask us to reproduce material that infringes another person's rights. You grant SKYDOG the limited rights necessary to evaluate and perform the requested service. Third party services

The website may rely on third party services for hosting, payment, scheduling, forms, shipping, analytics, and communications. Those providers may have separate terms and privacy practices. SKYDOG is not responsible for third party services outside our reasonable control, but this provision does not limit obligations imposed on us by law.

Disclaimer and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE IS PROVIDED AS AVAILABLE. EXCEPT FOR OUR EXPRESS LIMITED WARRANTY AND RIGHTS THAT CANNOT BE WAIVED, SKYDOG DISCLAIMS OTHER EXPRESS WARRANTIES REGARDING THE WEBSITE. NOTHING IN THESE TERMS DISCLAIMS OR LIMITS AN IMPLIED WARRANTY OR CONSUMER RIGHT THAT APPLICABLE LAW DOES NOT ALLOW US TO DISCLAIM OR LIMIT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYDOG WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE WEBSITE OR A TRANSACTION. WHERE A LIMITATION IS PERMITTED, SKYDOG'S AGGREGATE LIABILITY ARISING FROM A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT PAID FOR THAT PRODUCT OR ORDER. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE LIMITED.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Skydog Jewelry LLC harmless from third party claims arising from your unlawful misuse of the website, violation of these Terms, or infringement caused by materials you supplied. This obligation does not apply to claims caused by SKYDOG's own unlawful conduct.

Governing law and disputes

These Terms are governed by California law, without regard to conflict of law rules, except where another jurisdiction's mandatory consumer law applies. Any dispute not resolved informally will be brought in a court with lawful jurisdiction in Orange County, California, unless applicable law gives the consumer the right to proceed elsewhere.

Before filing a claim, please contact jordan@skydogjewelry.com and provide a reasonable opportunity to resolve the issue. This informal contact requirement does not shorten or waive any legal deadline or require participation in a procedure that applicable law prohibits.

Changes and severability

We may update these Terms prospectively by posting a revised effective date. The Terms in effect when an order is placed govern that order unless a change is required by law or the parties agree otherwise. If a provision is unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect.
